Welcome to Spiriway. These Terms of Service ("Terms") govern your use of
the Spiriway website located at spiriway.com (the "Site"),
the Spiriway mobile application (the "App"), and the services, features, and content offered by Spiriway LLC ("we," "us," or "our").
By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy, located at https://spiriway.com/privacy-policy.
Spiriway provides spiritual education, articles, definitions, and community forums.
We also offer a premium subscription, "Spiri+," which provides access to extra features and quality-of-life improvements.
Our Services are not intended for use by anyone under the age of 18. By using our Services,
you confirm that you are at least 18 years old.
If we become aware that a user is under the age of 18,
we will terminate their account and take steps to remove their personal information from our systems.
The content and services provided by Spiriway are for informational, educational, and entertainment purposes only. You agree not to rely on any Content or interactions on the Services as a substitute for professional medical, legal, financial, or mental health advice. Always seek the advice of a qualified professional for any such concerns.
Spiriway makes no guarantees regarding the results of using our content or services. Your personal and spiritual growth is dependent on your own effort and interpretation.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You may be able to post content, such as comments and chat messages ("User Content"). You retain ownership of your User Content, but you grant Spiriway LLC a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, and display your User Content in connection with the services.
You agree not to post User Content that is illegal, defamatory, obscene, threatening, or otherwise objectionable. We reserve the right, but not the obligation, to remove or edit User Content at our sole discretion.
Spiri+ Subscriptions: Subscriptions purchased through our App are managed by the respective app stores (Apple App Store, Google Play Store). Billing, renewals, and cancellations are subject to the terms and conditions of those platforms.
Donations: Donations made through our Site are processed by our third-party payment processor, Stripe. By donating, you agree to Stripe's terms of service. Donations are voluntary and generally non-refundable.
All content on the Site and App, including text, graphics, logos, and software (excluding User Content), is the property of Spiriway LLC and is protected by copyright and other intellectual property laws.
Spiriway LLC respects the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon a copyright you own or control, please immediately notify our Designated Copyright Agent using the contact information provided below (a "Notification"). A copy of your Notification will be sent to the person who posted or stored the material addressed in the Notification.

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Services or any Third-Party Content posted on, available through, or installed from the Services.
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
You agree not to use the Application in any way that violates any applicable law or regulation, infringes on the rights of others, or is harmful to the Application or its users. Prohibited conduct includes, but is not limited to, the following:
Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
Circumvent, disable, or otherwise interfere with security-related features of the Services.
Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
Use any information obtained from the Services in order to harass, abuse, or harm another person.
Make improper use of our support services or submit false reports of abuse or misconduct.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Engage in unauthorized framing of or linking to the Services.
Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other disruptive material.
Engage in any automated use of the system, such as using scripts, robots, or data mining tools.
Delete the copyright or other proprietary rights notice from any Content.

Upload or transmit any material that acts as a passive or active information collection mechanism (e.g., spyware, cookies).
Interfere with, disrupt, or create an undue burden on the Services or its networks.

Attempt to bypass any measures of the Services designed to prevent or restrict access.
Copy or adapt the Services’ software code.

Use the Services as part of any effort to compete with us or for any revenue-generating or commercial enterprise not expressly authorized by us.
Use the Services to advertise, offer, sell, or promote goods, services, coaching, readings, programs, or other commercial offerings, including directing users to external websites or soliciting clients off-site, unless expressly authorized by Spiriway in writing through a separate Partner Agreement.
Solicit, pressure, or encourage other users to communicate, transact, or engage off the Services for commercial, manipulative, or exploitative purposes without authorization.
Use the Services, Content, or user interactions for training artificial intelligence systems, machine learning models, or automated decision systems without our prior written consent.
Engage in conduct that undermines the spirit of the Services as a safe, non-exploitative, and respectful environment for personal reflection and growth.
The safety of children is paramount. Your use of the Services is contingent upon your adherence to our Spiriway Child Sexual Abuse and Exploitation (CSAE) Standards, which are hereby incorporated into these Terms by reference. Any content that violates these standards, or that depicts, promotes, or enables the abuse or exploitation of children, will result in immediate termination of your account and a report to appropriate law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC).
We reserve the right to determine, in our sole discretion, whether conduct violates these Terms and to take appropriate action, including removal of content, suspension of your account, or termination of your access to the Services, without prior notice.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by mediation in Madison County, Kentucky, USA.
To the fullest extent permitted by law, Spiriway LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our services.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the service after any such change constitutes your acceptance of the new Terms.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
These Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
The failure of Spiriway LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Spiriway LLC.
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our express prior written consent. We may assign, transfer, or delegate our rights and obligations under these Terms without restriction.
