Attempting to gain unauthorized access to the Application or its servers;

Using the Application to distribute malware or other harmful software;
Impersonating another person or entity while using the Application
Spiriway reserves the right to terminate or suspend your access to the Application at any time and for any reason, including if you violate this Agreement or for any other reason. Upon termination, you must immediately cease using the Application.
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SPIRIWAY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL SPIRIWAY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF SPIRIWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without giving effect to any principles of conflicts of law.
This Agreement constitutes the entire agreement between you and Spirway with respect to your use of the Application and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Spirway.
Spirway reserves the right to modify this Agreement at any time, in its sole discretion, without prior notice. Your continued use of the Application after any such modification constitutes your acceptance of the revised Agreement.
